NANNY & CAREGIVERS TERMS AND CONDITIONS AGREEMENT
Family Care Connection Inc. (FCC) is a referral service that
provides its clients with information respecting potential Nannies
and Caregivers in exchange for a fee. The Nanny agrees to disclose the following information to prospective clients (parents)
full name, phone number or email address, experience,
qualifications, names and numbers of references, days and hours wishing to work. The Nanny
agrees to release information that is complete, true and accurate,
the Nanny must be 18 or older and be entitled to work in Canada.
Information will be released to clients by a Childcare Agent
employed by (FCC). Under no circumstance will (FCC) release your
personal information to any third parties, or disclose it to
prospective clients on our website, as per our Privacy Policy. There
is no charge for the Nanny to join our agency. There is no contract
or obligation to remain with the agency for any time frame.
Relationship
(FCC) and the Nanny acknowledge that there is no employee/employer
relationship between the Nanny and the agency. The Nanny does not
have, nor shall have any right, power or authority to create any
contract or obligation, either express or implied on behalf, in the
name of, or binding upon (FCC).
The nanny cannot work for other clients using the (FCC) name and
reputation.
(FCC) agrees to provide honest and accurate information respecting
the Nanny to the clients who pay a fee in exchange for this
information. The Nanny is not entitled to any compensation
whatsoever for agreeing to enter information, or anytime the
information is released to a client. The Nanny can withdraw from the
agency at any time for no charge or obligation.
The nanny can agree to “try out” for a day with potential employer,
so long as (FCC) personal has been advised. The try out term will
be no longer than one 8-hour day, and the client must agree to pay a
full days wage at a pre-negotiated wage. While the nanny is working
for the trial day, the client will assume full responsibility for
the nanny’s safety and well-being. Should the family ask the nanny
to work 2 or more trial days in a row, we will assume you have been
“hired” and you must alert an (FCC) agent immediately.
(FCC) is under no obligation to find or provide a job to any nanny
that has been interviewed. We are a matching service and provide no
guarantee that the right job will be found. (FCC) has the right to
terminate our agreement with the nanny at any time, for any reason,
including but not limited to unprofessional conduct,
misrepresentation of our image, and company name, lateness, no
showing, drug or alcohol abuse, previous or current criminal record.
Legal
(FCC) does not provide any representations or warranties to the
Nannies regarding any client. (FCC) provides only an introduction
service between the Nanny and prospective clients and will refer
their name to suitable clients. (FCC) cannot guarantee a Nanny will
be interviewed or hired by any prospective clients, nor can we
warrant the length of employment the nanny will have once hired. Any
Nanny/client interviews, police checks, CPR & First Aid training
required will be the responsibility and expense of the Nanny. We
strongly recommend the Nanny discusses wages and working conditions
with the client, and signs a Nanny Work Agreement prior to beginning
work. (FCC) will not provide any representation or warranties of
negotiating any wages, loss of wages, termination, and working
conditions that result or may result in working for the client. The
Nanny is under no legal obligation to work for a particular client,
and may request to be placed in another placement at their
discretion. The Nanny hereby release Family Care Connection Inc.(FCC)
and its officers, agents, employees, and affiliates from all claims,
liabilities, injuries, demands, suits, actions, causes of actions of
every kind arising out of or resulting from the action of (FCC) or
the release of any information by (FCC).
The above parties agree that (FCC) shall not be liable to the Nanny,
or to any other person, including, but not limited to the Nanny’s
family or their successors, heirs and assigns, or any other person,
for incidental or consequential losses, damages or expenses,
directly or indirectly arising from any action or failure to act by
a client. It is agreed that there is no representation, warranty,
collateral agreement or condition affecting this agreement except as
expressed in it. Furthermore, it is agreed that this written
instrument embodies the entire agreement of the parties except as
expressly set out in this instrument. The Nanny acknowledges having
read, understood and agreed to the terms and conditions of this
agreement which are set forth in this agreement.
