Family Care Nanny

PARENTS/EMPLOYER TERMS AND CONDITIONS AGREEMENT

Family Care Nanny is a referral service that provides its clients with information respecting potential Nanny candidates for a fee. Every Nanny has been personally interviewed by the agency and meet the following requirements: Nannies must complete a valid Criminal background check, CPR/First Aid certificate and have 3-4 references which have been verified by our agency. Family Care Nanny does not warrant the accuracy of such information provided to us, nor do we warrant the suitability of a potential caregiver for any given client or situation.

Referral Service
We are a referral service only, and do not employ the Nannies or Caregivers. We simply act as an employment agency to assist the caregivers in finding suitable employment placements in their area. Once we recommend the caregivers to the client, it is the client’s sole discretion to hire the caregiver or do another search to find better-suited caregivers. The client is under no obligation to employ the caregivers we refer. The client may request more than one referral at no additional cost, if unsatisfied with the initial referral. Family Care Nanny does not guarantee or warrant how long it will take to find a suitable nanny candidate as each situation is unique.  Once the client has hired a caregiver, the client then becomes the employer. The client is then responsible for the caregiver’s safety, working conditions, payable wages, insurance and taxes (if applicable). The client agrees they do not have the right to sell, re-sell, download, exploit any of our nanny/sitter services, copy, sell, re-sell, exploit, transmit any confidential information regarding nannies to any other third parties.

Caregiver/Agency Relationship

The client and Family Care Nanny acknowledge that there is no employee-employer relationship between the agency and the caregivers. The sole obligation of the agency is to provide the client with Caregiver referral information for a fee. Clients wishing to have the nanny “try out” on the job may do so by requesting through a Family Care Nanny agent, and for no more than one 8 hour day. While the nanny is working for the trial day, the client assumes full responsibility of the nanny’s safety and well-being. The nanny must be paid in full for the trial day at a pre-negotiated wage. If the nanny is asked to try out for 2 or more days, Family Care Nanny will deem that nanny “hired” and collect the placement fee.

Legal   

The client acknowledges that our registration fee is non-refundable.  Once the registration fee is collected Family Care Nanny will proceed with the nanny search and send suitable nannies for the client to interview and ultimately hire.  Family Care Nanny does not warrant how many nannies will be sent to the client to interview, or how long the process will take.  We make every effort to provide qualified, screened nannies that will meet the criteria the client is seeking within an efficient time-frame.  The client agrees to pay the placement fee as soon as the nanny has been offered a job and has accepted, and prior to job commencement.  The client acknowledges, and agrees that the type of service purchased is the type of service required.  The client has no right or authority to make any other working arrangements with the Family Care Nanny nanny, or any third party without Family Care Nanny consent.

Family Care Nanny does not provide any representations or warranties to the client relating to the Nannies, Caregivers or childcare service provided by the caregivers. Family Care Nanny provides an introduction service only, and background reference checks related to the Nannies only. Once introduced, the caregivers are the sole responsibility of the Client. Family Care Nanny is not liable for the negotiation of wages, working conditions, availability or quality of caregiver service, or any other arrangements between Client and Caregiver. Family Care Nanny does not provide monitoring or supervision of nannies or caregivers once they are employed by the parent. The client agrees to release Family Care Nanny from any claims, suits, actions, causes of action, damages, incidental or consequential losses, expenses, accidents, injuries, or damages. It is agreed that there is no representation, warranty, collateral agreement or liability created hereby, except as expressly stated herein. The client agrees that all information given to Family Care Nanny agents regarding registration for employing a nanny is accurate and true.
